In exercise of the powers conferred by Section 43(1) read with Section 181(2)(t), Section 44, Section 46 read with Section 181(1), Section 47(1) read with subsection 181(v), Section 47(4) read with Section 181(w), Section 47 (2,3,5), Section 48(b),  Section 50 read with Section 181(2)(x)  and Section 56 of the Electricity Act,  2003 (No. 36 of 2003) and Section 9(j) of Madhya Pradesh Vidyut Sudhar Adhiniyam, 2000 (No. 4 of 2001), the Madhya Pradesh Electricity Regulatory Commission hereby makes the following Amendments  in the Madhya Pradesh Electricity Supply Code, 2004 notified vide No. 861/MPERC/04 dated 27^th March, 2004. 

FOURTEENTH  AMENDMENT TO MADHYA PRADESH ELECTRICITY SUPPLY CODE, 2004

1.                  Short Title and Commencement

(i)          This Code may be called the “Madhya Pradesh Electricity Supply Code, 2004 (Fourteenth Amendment) (AG-1(xiv) of 2007)”.

(ii)        This Code shall come into force with effect from the date of its publication in the official gazette.

(iii)        This Code shall extend to the entire State of Madhya Pradesh.

2.                  Amendment to Chapter I : 

      (i)   In the Madhya Pradesh Electricity Supply Code, hereinafter called the Principal Code, for the sub clauses (a), (b) and (d) of clause 1.6, the following shall be substituted namely; 

“(a)   CMD of each Distribution Licensee of the State or his nominated representatives.

 (b)   CMD of State Transmission Utility (STU) and Transmission Licensees or their nominated representatives.

 (d)   Any other interested stakeholder or group as the Commission may think fit”.

(ii)     In  the Principal Code, for the Clause 1.7 as amended vide Madhya Pradesh Supply Code, 2004 (Sixth Amendment) [AG-1(vi) of 2006] dated 15 June, 2006, the following shall be substituted, namely:

 “The Commission shall appoint a Chairman and a Member Secretary from among the representatives of the Distribution Licensees.  The post of the Chairman shall be taken over by the CMDs of each Distribution Company (Discom) by turn as may be specified by the Commission.  The CMD, who takes over as Chairman of the Review Panel, shall appoint an officer from the same Discom as Member Secretary.  The same Licensee shall provide all the required support, administrative or otherwise.  All members of the review panel shall be appointed for a period of two years”.
